Law Suit Seeks to Punish Girl Friend Who Texted Her Driver Boyfriend Causing Accident in New Jersey

As you know, texting and driving can be dangerous and you may be sued for doing it if you cause any accidents. But now texting to friends who are driving may also bring in serious legal issues.

That is what is happening to a girl who texted her boyfriend who was driving a truck and collided to a couple on a motorbike causing a serious accident in New Jersey.

The incident happened back in 2009 when a truck driver in busy traffic, tried to read and respond to a text message send by his girl friend, lost control of his vehicle and collided with a motorcycle coming in the opposite direction causing serious accident.

The couple on the motor cycle suffered serious injuries and the husband had to have his left leg amputated above the knee while his wife also had to have one of her legs amputated below the knee.

However, now the Superior Court judge in Morristown, New Jersey is considering  whether the girl friend who  texted the driver knowingly that he was driving should be held responsible for distracting the attention of the driver while he was behind the wheel .

The driver pleaded guilty to use cell phone while driving and was fined $775. But the law suit also seeks to sue his girlfriend for texting and distracting driver’s attention.

While a decision will be made on May 25th, it will be decisive what the judge says. If he approves it, that will trigger a lot of similar law suits across the US. So be careful next time you text somebody, at least till May 25.
